I have a question. I have H1B valid till 2012 under company A and I am working for company A now. Company B is offering me part time employment and they transferred existing H1B transfer. Now I have two H1Bs after transfer, literally. Am I correct? Now I am eligible to work for both the companies. Am I correct?
There is nothing called H1-B *transfer*. Each employer does a brand new petition. Once the second petition is approved (and you got I-94, etc.), your status depends on how the second petition was filed:
(i) If the second petition was filed as concurrent, then you can work for both the employers.
(ii) Otherwise, you can work only for one employer.
So you need to know how Company B filed their petition.

My attorney signed my I-485 AOS/EAD/AP applications and posted them on July 2nd as he was in a hurry to apply because of July 2nd scenario. Is it ok for the attorney to sign our papers. Is anybody in the same boat as me. I am a little concerned as the USCIS FAQ says application can be rejected if signature is missing. The application reached USCIS on July 3rd.
My attorney also did the same. I did not sign on my application. But he sent me power of attorney to sign. They did this since they were beating the July 2 brouhaha which previous to that week, they already knew what's going to happen.

Dear All,
I got a labor substitution and filed for my I-140 and I-485 concurrently. Today was the last day to send the documents and some paperwork was missing for my wife! I missed sending the package!
Now how should i proceed?? My wife is on H1-B currently. Any ideas??
My priority date is 25 jan 05 - eb2.

If you missed this time around, you can apply 485 for your wife only when your PD becomes current. Your wife will have to continue working on her H-1B since EAD isn't an option anymore.
Just curious: what paperwork was missing as a result of which you missed this boat? I hope it wasn't trivial in the grand scheme of things.

I agree with Anders. Diagonals are always a nice draw for the eye. Also, a little more DoF would be nice because the bottom right of the leaf is just creeping out of the focal plane. Cool leaf texture, good choice of subject.

Hello,
My husband's employer told him that the 6 year H1 B stay cap has been eliminated since the year 2008. Is that true?
Does it mean that as long as the USCIS approves your H1-B extension you may apply even after 6 years?

My current H1 expires on the 30th of September 2007. I have applied for H1 extension under premium processing and it is pending.
My Query is:
Can I work after my H1 expires on the 30th and my H1 extension is still pending? i.e. continue working based on a pending H1 application? If so, for how long?

Yes, you can continue to work on pending H1 application. On pending H1 extention there is no limit for how long you can keep working. if you get an approval then you can just continue working till your next H1 expires and
thus you dont have to take a break.

I am planning to go to Canada for H1B visa stamping. Will there be any problem if i have company on H1B. I opened in 2003 and My friend is working in that company. I am working for my employer only. Will there be any problem if i have company either in GC stage or getting Visa in Canada.

There has been a lot of talk recently about what might be included in an immigration reform bill. Will there be a legalization/amnesty/forgiveness of "lawbreakers" rule? Will there be an expansion of employment based and family based immigrant visa numbers to solve the economically devastating backlogs we currently deal with? Will there be a mandatory E-Verify component? Will there be an interior enforcement focus? Will there be even more fences?
The topic that seems to be lost in all this speculation is something I consider to be the overriding component of reform--the Key to holding a reform package together. I am speaking, of course, of Due Process Restoration. Anyone who deals with immigrants for any length of time is intimately familiar with the disaster that is our immigration enforcement system. It is not just that previous administrations have done a horrific job at the enforcement that should have been taking place, but rather, the missing component to that enforcement. When is the last time an ICE officer worried about Due Process considerations? What is really destroying immigrant families--how about 212(a)(9)(B) and (C)? What about the concept of "civil" detention in real jails with real criminals for non-criminal immigrants? What about the detention of Asylum Seekers? What about the ludicrous requirements of REAL ID for asylum seekers?
These are all only a few of the regular violations of concepts most American hold sacred. When you tell the 'average' American about the system immigrants actually have to deal with, most are appropriately appalled. It is to those Americans that we must speak. I believe that if Senator Schumer has the courage to include Due Process Restoration in his "Comprehensive" immigration reform bill, it will be tragically necessary for us to defend these Due Process provisions of the reform package.
